By creating an account and using DriveInstruct ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms form a legally binding agreement between you and Nimble Panda Ltd (trading as DriveInstruct), a company registered in England and Wales.
DriveInstruct is a software platform that helps driving instructors and driving schools manage lesson bookings, student records, payments, and communications. The Service is provided on a subscription basis.

Payments are processed securely by Stripe. DriveInstruct does not store your card details.
If you subscribe to the Pro plan and receive no student enquiries through the DriveInstruct marketplace during your first 12 months of paid subscription, we will refund the subscription fees you have paid for that period in full. To qualify:
Refunds are issued to the original payment method where possible. Where the payment provider no longer permits a refund to that method, we will pay by bank transfer instead.
The first 10 schools to subscribe to the Pro plan pay a founding-member rate of £5 per month instead of the standard £10, and that rate is locked for as long as the subscription remains continuously active, including after the standard price rises. If the subscription is cancelled and later restarted, the founding rate no longer applies and the standard price at that time will be charged. Founding-member slots are allocated in the order subscriptions are completed, and the offer ends once all 10 are taken. A cancelled founding subscription does not return its slot to the pool.
When you use DriveInstruct to store information about your students, you are the Data Controller under UK GDPR and the Data Protection Act 2018. DriveInstruct acts as the Data Processor. This means:
DriveInstruct processes student data solely to provide the Service to you and will not use it for any other purpose.
You agree not to:
DriveInstruct and its content, features, and functionality are owned by Nimble Panda Ltd and are protected by copyright and other intellectual property laws. Your student data remains your property at all times.
We aim to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. We may temporarily suspend the Service for maintenance. We are not liable for any losses arising from downtime.
To the maximum extent permitted by law, Nimble Panda Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid in subscription fees in the 12 months prior to the claim.
We reserve the right to suspend or terminate your account if you violate these terms. You may terminate your account at any time. Upon termination, your data will be retained for 30 days and then permanently deleted.
We may update these terms from time to time. We will notify you by email at least 14 days before any material changes take effect. Continued use of the Service after changes constitutes acceptance of the new terms.
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
